Terms of Use
1. Acceptance of Terms
By accessing or using Amanah Finance Intelligence (“Amanah”, “we”, “us”, or the “Service”), you agree to these Terms of Use governing your access to and evaluation of the Early Beta platform, together with our Privacy Policy. If you do not agree to these Terms, you must discontinue use of the Service.
2. Early Beta Status and Experimental Nature
You acknowledge and agree that Amanah Finance Intelligence is currently in an Early Beta stage. The Service is made available on an experimental, evaluative basis for testing and constructive feedback.
- Features and functionality may change, be modified, or be removed at any time without notice.
- Software defects, calculation delays, parsing inaccuracies, or service downtime may occur.
- The Service should not be relied upon as your primary, sole, or audited record of financial holdings, transactions, or accounting statements.
3. Eligibility & Age Requirement
The Service is intended strictly for individuals who have reached the age of majority in their jurisdiction (at least 18 years of age) and who possess the legal capacity to enter into binding agreements. By accessing the Service, you represent and warrant that you meet these eligibility requirements.
4. Account Registration and Security
To access the Service, you may register via email credentials or authenticate using Google Sign-In. You agree to provide accurate and complete information and to keep your account details current.
You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify Amanah immediately of any unauthorized use or security compromise of your account.
5. User-Provided and Imported Data
Amanah allows you to input financial data and upload files, including Interactive Brokers (IBKR) Activity Statements in CSV format and Amanah holdings CSV spreadsheets.
- Authority to Import: You represent and warrant that you own or have the full legal right, authorization, and consent to upload, import, and process any financial data or account statements you submit to the Service.
- Processing License: You grant Amanah a limited, non-exclusive, revocable license to store, parse, normalize, and display your imported data strictly to provide the Service to you.
- Verification Responsibility: You acknowledge that automated CSV parsing may encounter unmapped symbols, ambiguous corporate actions, or formatting variations. You remain solely responsible for verifying the correctness of all imported holdings and balances.
6. No Investment Advice or Financial Advisory Relationship
- The Service does NOT provide personalized investment recommendations, investment advisory services, financial planning, portfolio management, or trading guidance.
- No content, assessment indication, change alert, thesis note, or portfolio metric generated by the Service constitutes an offer, solicitation, or recommendation to purchase, hold, or sell any security, fund, commodity, or financial instrument.
- All investment decisions, risk assessments, and asset allocations are made solely and independently by you. You should consult qualified financial, legal, and tax professionals before making any investment decisions.
7. Shariah Assessment Scoping and Religious Disclaimer
Amanah incorporates scoped Shariah-aware assessments. You explicitly acknowledge and agree to the following foundational principles of the Amanah truth doctrine:
Unassessed business segments or missing disclosures are never assumed to be compliant or zero.
The absence of a review marker does not imply Shariah compliance or endorsement.
A business-activity assessment is strictly limited to recorded business lines and is not a complete Shariah audit. Financial-ratio screening is not claimed where not implemented.
Synthesized notes and commentary never replace primary company filings, prospectuses, and audited evidence.
Amanah is NOT a Shariah supervisory board, certification agency, or fatwa-issuing institution. We do not issue religious rulings (fatwas). If you require binding religious assurance or institutional Shariah certification, you must consult qualified Islamic scholars and Shariah advisory boards.
8. Valuation, Performance & Market Data Disclaimers
- Snapshot Changes Are Not Trades: Differences between consecutive imported broker snapshots reflect changes between documented states; they do not prove that a trade or execution occurred on a specific date, and do not represent verified investment performance.
- Marks Are Not Executable Prices: Prices and valuations displayed on the platform reflect broker statement marks, user-entered values, or historical reference data. They are not guaranteed real-time market quotes and must not be used to execute market orders.
- Partial Cost Basis Coverage: Where cost-basis information is incomplete, documented P&L metrics reflect only the coverage available and must not be interpreted as total or tax-compliant return calculations.
9. No Brokerage or Custodial Relationship
Amanah does not hold funds, hold securities, clear transactions, or act as a custodian or broker. All assets referenced in the Service remain held by your third-party custodian or brokerage firm.
10. Acceptable Use Policy
When using the Service, you agree not to:
- Use the Service for any unlawful purpose, fraud, or violation of applicable financial regulations.
- Upload or import financial data or statements belonging to third parties without express legal authorization.
- Attempt to reverse engineer, decompile, extract source code from, or create derivative works of the software.
- Interfere with, disrupt, or launch automated attacks (including scraping, denial-of-service, or vulnerability probes) against the Service or its hosting infrastructure.
- Circumvent or attempt to circumvent authentication gates, Row-Level Security policies, or tenant boundaries.
11. Intellectual Property
All rights, title, and interest in and to the Service—including software code, algorithms, User Interface designs, trademarks, logos, domain models, and documentation—are and remain the exclusive intellectual property of Amanah. Except for the limited right to use the Service under these Terms, no license or rights are granted to you.
You retain all ownership rights in the portfolio data and statement files you upload to the platform.
12. Third-Party Services
The Service integrates with third-party providers (including Google OAuth, Supabase, and Vercel). Your use of third-party features is subject to the respective terms and policies of those providers. Amanah is not responsible for the availability, accuracy, or conduct of any third-party services.
13. Service Modifications, Suspension and Termination
Amanah reserves the right, at its sole discretion, to modify, update, suspend, or discontinue any part of the Early Beta Service at any time, with or without prior notice.
We may suspend or terminate your account and access to the Service immediately if we believe you have violated these Terms, pose a security risk, or if continued access would subject Amanah to legal or regulatory liability.
14. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITH ALL FAULTS AND DEFECTS.
AMANAH EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
WITHOUT LIMITING THE FOREGOING, AMANAH DOES NOT WARRANT THAT THE SERVICE WILL BE ACCURATE, COMPLETE, RELIABLE, UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT ANY PARSING DISCREPANCIES OR DEFECTS WILL BE CORRECTED.
15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL AMANAH, ITS OPERATORS, OR CONTRIBUTORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF DATA, GOODWILL, TRADING LOSSES, OR INVESTMENT LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO, USE OF, OR INABILITY TO USE THE EARLY BETA SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AMANAH’S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICE SHALL BE LIMITED STRICTLY TO DIRECT DAMAGES, IF ANY, AND SHALL NOT EXCEED THE MINIMUM EXTENT PERMITTED UNDER MANDATORY APPLICABLE LAW. NOTHING IN THESE TERMS EXCLUDES OR LIMITS ANY LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
16. Governing Law and Jurisdiction
The Early Beta service is operated from the United Arab Emirates. To the extent permitted by law, these Terms and your use of the Service are governed by the laws applicable in the United Arab Emirates. This provision does not deprive you of any mandatory statutory consumer protections under the laws of your country of habitual residence that cannot be derogated from by contract.
(Note: This governing law and dispute-resolution provision is an operational Early Beta formulation and will be subject to professional legal review before commercial release.)
17. Changes to Terms of Use
We may update or modify these Terms from time to time. When changes are made, we will update the “Effective Date” at the top of this page. Your continued use of the Service following the posting of revised Terms signifies your acceptance of the changes.
